• Your role:
  A great opportunity to join our North West Africa Team (Maghreb & French speaking Africa). We are hiring a Head of Legal who will report to the Head of Legal Middle East, Africa and Russia/CIS. In this role you will be responsible to provide comprehensive legal support to the regional business. You will work closely with other members of the Legal Healthcare team on special legal projects and represent the Legal Department on inter-departmental matters. 
  Your scope will be to support the two other sectors of Merck (Life Science and Performance Materials) as needed, local Merck legal entity in Tunisia as well as any other legal entity of Merck throughout the region NWA.

• The Head of Legal NWA shall also contribute to promote the legal department as a reliable business partner, providing excellent commercial legal support to ensure the organization remains competitive whilst being compliant and managing risks.
• Your responsibilities will include: identifying, drafting, negotiating and preparing necessary contracts (including, as a matter of example, including promotional, consulting, manufacturing and distribution agreements other than their extensions, amendments and terminations) as well as other legal documentation in support of business transactions in the Healthcare, Life Science and Performing Material sectors of Merck. Providing advice to the business on potential legal risks in relation to the proposed business transaction and where necessary to obtain external legal advice. And working with the marketing teams to provide legal review and approval, where requested, in relation to promotional material and campaigns to ensure compliance with the industry code of practice and other relevant laws and regulations.
• You will also be in charge of providing comprehensive legal support to country operations, including legal support to the corporate house-keeping activity for all the local entities in Tunisia and in the rest of the NWA Region directly or through the management of local external counsels as needed. Managing risks through counseling and practical application of Merck policies and procedures. And serving as primary counsel for key regional projects and meetings as assigned by the Head of Legal Biopharma Middle East, Africa, Turkey and Russia.

You will also be responsible for keeping the Merck business in NWA Region up-to-date with relevant regulations of the industry and advise the business accordingly and providing support for company-wide functions outside of the NWA Region as assigned. In addition to this you will coordinate legal NWA activities which could have an impact at a European or Global level with Group Legal and other relevant stakeholders based in Head Quarter; support the Compliance department with legal guidelines and the Market Access department in Pricing & Reimbursement activities as well as in any other legal discussion with the national pharma agency, the Ministry of Health and Regions;

• You will work in collaboration with the Regulatory department in all the legal issues arising from its activity. Plus providing proactive advice and training in relation to data protection; and handling claims and litigation and any investigations by external authorities;
• Finally you will provide support in relation to Merck Performing Materials and Merck Life Science in NWA as assigned from time to time and also support on other related duties or projects as requested from time to time.

Who you are:

• Law degree and admission to the Tunisian Bar.
• Minimum of seven years’ post qualified experience in Tunisia and abroad required.
• Fluent in English, Arabic and French.
• Legal experience at a large (possibly international) law firm or a multinational corporation, involving international legal issues and business transactions.
• Previous professional experience in the following legal areas: civil law, commercial contracts, corporate and competition law, public law, labor law, data protection, compliance.
• Knowledge of Pharmaceutical Industry and associated legislation, regulations and guidelines as well as a previous experience in a similar role  in pharmaceutical / healthcare or highly regulated industry is preferred.
